1. Acceptance of Terms
By accessing or using Tally Assistant ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free trial users and paid subscribers.
2. Description of Service
Tally Assistant is an AI-powered financial management platform for freelancers and small businesses. It provides tools for transaction tracking, invoice generation, expense management, time tracking, and financial reporting.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.
4. Subscriptions and Payments
4.1 Billing
Tally Assistant offers both free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected during checkout. All payments are processed securely by Paddle, our authorized payment processor. We accept major credit cards, debit cards, Apple Pay, and Google Pay.
4.2 Pricing Changes
We reserve the right to modify our pricing with 30 days' notice. Price changes will not affect your current billing cycle. We will notify you via email before any price change takes effect.
4.3 Taxes
All prices are exclusive of applicable taxes (VAT, GST, sales tax, etc.). Where required by law, taxes will be calculated and added to your invoice by Paddle at checkout.
4.4 Refund Policy
We offer a 14-day money-back guarantee on all paid subscription plans (monthly and annual). If you are not satisfied with the Service for any reason, you may request a full refund within 14 days of your initial purchase date.
How to request a refund
Email [email protected]with the subject "Refund Request" and include the email address associated with your account. We will process your refund within 5 business days. Refunds are issued to the original payment method.
What is covered
- First-time purchases of any paid plan — full refund within 14 days
- Annual plan upgrades from monthly — 14-day refund window on the new annual charge
What is not covered
- Renewal charges after the initial 14-day period
- Partial months of service — we do not offer pro-rated refunds for mid-cycle cancellations
- Downgrades from a higher-tier plan to a lower-tier plan (you will retain access until the end of the current billing period, then renew at the lower rate)
After the refund
Your account will immediately revert to the Free plan. You will retain access to all your data. Any features exclusive to paid plans will no longer be available.
5. Cancellation
You may cancel your subscription at any time from your account Settings page. Upon cancellation, your account will revert to the Free plan at the end of your current billing period. Your data will be retained for 90 days after cancellation, after which it may be permanently deleted.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to access, probe, or connect to computing systems without authorization
- Upload or transmit viruses, malware, or any malicious code
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to store or process financial data of third parties without proper authorization
7. Data and Privacy
Your use of the Service is subject to our Privacy Policy. You retain ownership of all financial data you enter into the Service. We use industry-standard encryption and security measures to protect your data.
8. User Responsibilities & Financial Accuracy
8.1 Data Entry & Review
You are solely responsible for the accuracy of all data you enter into the Service, including but not limited to transaction amounts, dates, currencies, categories, client information, and payment account details (e.g. PayPal email addresses). Always verify AI-generated or auto-parsed data before relying on it. The Service is a tool to assist your bookkeeping — it does not replace professional accounting or tax advice.
8.2 Payment Information
If you provide a payment account (such as a PayPal email address) for invoice payments, you are responsible for ensuring it is correct and belongs to you. Tally Assistant is not responsible for payments misdirected due to incorrect payment details provided by you. We recommend testing a small payment before sending invoices to clients with payment links.
8.3 Tax & Legal Compliance
You are responsible for complying with all applicable tax laws, including accurate reporting of income and expenses. Tally Assistant does not provide tax, legal, or accounting advice. Consult a qualified professional for your specific situation.
9. Limitation of Liability
To the maximum extent permitted by law, Tally Assistant and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: lost profits, lost revenue, lost data, financial losses from inaccurate data entry or AI parsing, misdirected payments, tax penalties, business interruption, or any other commercial damages arising from your use of or inability to use the Service.
Our total aggregate liability for any claims under these Terms shall not exceed the greater of: (a) the amount paid by you to Tally Assistant in the 12 months preceding the claim, or (b) $100 USD. This limitation applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or otherwise.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- AI-generated or AI-parsed financial data, categories, or amounts will be accurate
- Currency conversions will match real-time market rates
- Any errors or defects will be corrected
You acknowledge that Tally Assistant uses third-party AI services for data parsing and analysis. AI-generated outputs may contain errors, omissions, or inaccuracies. You should independently verify all AI-generated content before using it for any purpose.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
